The Gambling (Betting) (Amendment) Ordinance, 2016

THE STATES, in pursuance of their Resolution of the 31^st July 2015[a], and in exercise of the powers conferred on them by section 2 of the Gambling (Guernsey) Law, 1971[b], and section 38(3) of the Gambling (Betting) Ordinance, 1973[c] hereby order:-

Amendments to the 1973 Ordinance.

1. The Gambling (Betting) Ordinance, 1973 ("the 1973 Ordinance"), is further amended as follows.

2. In section 18(2) of the 1973 Ordinance –

(a) after the comma at the end of paragraph (a), insert "or",

(b) at the end of paragraph (b), for ",or" substitute a full stop, and

3. In the First Schedule (Rules for Licensed Betting Offices) to the 1973 Ordinance –

(a) in paragraph 1 –

(i) for "Subject to paragraph 1A, a" substitute "A", and

(ii) in item (a), for "throughout every Sunday, Good Friday and," substitute "on", and

(b) repeal paragraph 1A.

4. In paragraph 9 of the Second Schedule (Authorisation of Bookmaker's Agents) to the 1973 Ordinance, for "throughout every Sunday, Good Friday and," substitute "on".

Interpretation.

5. (1) In this Ordinance -

"enactment" includes a Law, an Ordinance and any subordinate legislation and includes any provision or portion of a Law, an Ordinance or any subordinate legislation,

"subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any statutory, customary or inherent power and having legislative effect, but does not include an Ordinance, and

"the 1973 Ordinance" means the Gambling (Betting) Ordinance, 1973.

(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.

Repeals.

6. The Gambling (Sunday Credit Betting) Order, 1999[d] is hereby repealed.

Citation.

7. This Ordinance may be cited as the Gambling (Betting) (Amendment) Ordinance, 2016.

Commencement.

8. This Ordinance shall come into force on the 9^th June, 2016.
