The Offences (Fixed Penalties)

(Guernsey) Law, 2009

 

THE STATES, in pursuance of their Resolution of the 26th October, 2006[a], have approved the following provisions which, subject to the Sanction of Her Most Excellent Majesty in Council, shall have force of law in the Islands of Guernsey, Herm and Jethou.

 

Fixed penalty offences.

1.      An offence specified in column 1, and broadly described in column 2, of the Schedule is a "fixed penalty offence" for the purposes of this Law, provided that an offence which is committed by causing or permitting the use of a motor vehicle or boat by another person in a particular manner or in particular circumstances shall not be a fixed penalty offence.

 

Fixed penalty notices.

2.      (1)      In this Law, a "fixed penalty notice" means a notice in the form approved by the Department, with such variations as the circumstances may require, offering the opportunity of the discharge of any liability to conviction of a fixed penalty offence by payment of a fixed penalty in accordance with this Law.

 

(2)      A fixed penalty notice -

 

(a)      shall be issued in an electronic or written format, and

 

(b)      may be contained within a cover bearing the words "fixed penalty notice" and instructions for its extraction.

 

(3)      If a police officer finds a person on any occasion and has reason to believe that, on that occasion, that person is committing or has committed any fixed penalty offence, he may issue a fixed penalty notice in respect of that offence by giving it to that person.

 

(4)      If a police officer finds a motor vehicle on any occasion and has reason to believe that, on that occasion, any fixed penalty offence is being or has been committed in respect of that motor vehicle, he may issue a fixed penalty notice in respect of that offence by affixing it to that motor vehicle.

 

(5)      If a police officer finds a boat on any occasion and has reason to believe that, on that occasion, any fixed penalty offence is being or has been committed in respect of that boat, he may issue a fixed penalty notice in respect of that offence by affixing it to that boat.

 

(6)      A fixed penalty notice shall not relate to more than one offence.

 

(7)      A fixed penalty notice shall -

 

(a)      give sufficient particulars of the circumstances alleged to constitute the fixed penalty offence to which it relates in order to provide reasonable information about the alleged offence including, without limitation -

 

(i)      the date and time of the offence,

 

(ii)      the location of the offence,

 

(iii)      the nature of the offence,

 

(iv)      the details of -

 

(A)      the person committing the offence, or

 

(B)      the motor vehicle or boat in respect of which the offence has been committed, and

 

(v)      the details of the person issuing the fixed penalty notice,

 

(b)      bear a number and the date of its issue,

 

(c)      specify -

 

(i)      the band of the fixed penalty offence (being the band specified in relation to the offence concerned in column 3 of the Schedule) ("the band"),

 

(ii)      the amount of the fixed penalty (being the amount specified in relation to the offence concerned in column 4 of the Schedule), and

 

(iii)      the manner in which, and the place (being any of the places for the time being prescribed by an order made under section 5(1)) at which, the fixed penalty may be paid to the Chief Accountant,

 

(iv)      the consequences of failing to pay the fixed penalty in accordance with this Law, including without limitation, the possibility of the commencement of proceedings in the Magistrate's Court, and

 

(v)      the consequences of paying the fixed penalty in accordance with this Law, and

 

(d)      state that if the fixed penalty is paid within seven days following the date of the issue of the fixed penalty notice, the amount of the fixed penalty shall be reduced to the amount specified in relation to the offence concerned in column 5 of the Schedule.

 

Notice to owner.

3.      (1)      If, after the expiration of the seven days following the issue of a fixed penalty notice in relation to a fixed penalty offence committed in respect of a motor vehicle or a boat, the amount of the fixed penalty specified in it has not been paid in accordance with this Law, the Chief Officer of Police may serve a notice under this section (a "notice to owner") on the person appearing to him to be the owner of that motor vehicle or boat.

 

(2)      A notice to owner may be in any form from time to time determined by the Chief Officer of Police, but shall contain -

 

(a)      the particulars which were contained in the fixed penalty notice pursuant to section 2(7), and

 

(b)      a request to the person on whom the notice to owner is served either -

 

(i)      to ensure that the amount of the fixed penalty is paid in accordance with this Law, or

 

(ii)      to furnish the Chief Officer of Police with a true statement, signed by that person and in such form (if any) as may be specified in the notice to owner, to the effect that, at the time of the alleged fixed penalty offence, either he was not the owner of the motor vehicle or boat or it was in the possession of another person without his consent,

 

within 14 days of the date of the notice to owner, and

 

(c)      a statement of the consequences of failing to comply with that request.

 

(3)      The consequences referred to in subsection (2)(c) are that -

 

(a)      proceedings in respect of the fixed penalty offence referred to in the fixed penalty notice may be brought against the person on whom the notice to owner was served, and

 

(b)      for the purposes of those proceedings it shall be conclusively presumed (even if that person is not an individual) that he was in charge of the motor vehicle or boat at the time of the alleged offence and, accordingly, that acts or omissions of the person in charge of the motor vehicle or boat were his acts or omissions.

 

(4)      A notice to owner is validly served -

 

(a)      if the fixed penalty notice concerned relates to a motor vehicle or boat registered in Guernsey and -

 

(i)      it bears the name and address of the owner of the motor vehicle or boat, and

 

(iii)      it is delivered to him, or is sent by post to him at that address, and

 

(b)      in any other case, it is addressed to the person appearing to the Chief Officer of Police to be the owner of the motor vehicle or boat concerned and is delivered to him, or left at, or sent by post to -

 

(i)      in the case of an individual, his usual or last known place of abode,

 

(ii)      in the case of a firm, its principal or last known principal place of business,

 

(iii)      in the case of a company, its registered office, or, if its registered office is not in Guernsey, its principal or last known principal place of business in Guernsey.             

 

Suspending effect of fixed penalty notices.

4.      Proceedings shall not be taken against any person for an offence in respect of which a fixed penalty notice has been issued in accordance with section 2 -

 

(a)      during the seven days following the date of issue of the fixed penalty notice,

 

(b)      if the amount of the fixed penalty is paid in accordance with this Law within those seven days,

 

(c)      during the 14 days following the date of any notice to owner served in respect of that offence, or

 

(d)      if the amount of the fixed penalty is paid in accordance with this Law within those 14 days.

 

Payment of a fixed penalty.

5.      (1)      A fixed penalty is paid in accordance with this Law only if -

 

(a)      the full amount of the fixed penalty specified in the fixed penalty notice is paid to the Chief Accountant within the period specified in that notice or in a notice to owner served in respect of it,

 

(b)      the payment is made at such place, and in such manner, as the Department may prescribe by an order made under this paragraph including, without limitation, by electronic means (including via the internet), and

 

(c)      the payment is accompanied by, in either paper or electronic form -

 

(i)      the fixed penalty notice to which it relates,

 

(ii)      the number of the fixed penalty notice to which it relates,

 

(iii)      a notice to owner served in respect of that fixed penalty notice, or

 

(iv)      a letter to the Chief Accountant signed under the authority of the Chief Officer of Police setting out the number of the fixed penalty notice and the date of the offence concerned.

 

(2)      If any requirement of subsection (1) is not complied with by a person paying a fixed penalty to the Chief Accountant, the Chief Accountant shall as soon as reasonably practicable repay the amount paid to him in respect of that fixed penalty.

 

(3)      When a fixed penalty is paid in accordance with this Law -

 

(a)      the Chief Accountant shall, as soon as reasonably practicable -

 

(i)      inform the Chief Officer of Police of the payment,

 

(ii)      if the person making the payment requests a receipt and either makes it in person or gives a name and address to which the receipt may be sent, provide a receipt in paper or electronic form bearing the number of the fixed penalty notice concerned, and

 

(b)      the amount paid shall be treated as a fine imposed on a conviction by the Magistrate's Court.

 

Offences and penalties.

6.      (1)      A fixed penalty notice affixed to a motor vehicle under section 2(4), or a boat under section 2(5), shall not be removed or interfered with except by or under the authority of the driver, master or person in charge of the motor vehicle, or boat, or the person liable for the fixed penalty offence in question; and any person contravening this subsection is guilty of an offence and liable, on summary conviction, to a fine not exceeding level 2 on the uniform scale.

 

(2)      A person, who in response to a notice to owner, makes a statement which he knows to be false or misleading in a material particular, or recklessly makes a statement which is false or misleading in a material particular, is guilty of an offence and liable, on conviction, to a fine not exceeding level 4 on the uniform scale.

 

General provisions as to Ordinances and subordinate legislation.

7.      (1)      The States may by Ordinance amend the Schedule.

 

(2)      Without limitation, an Ordinance under subsection (1) may -

 

(a)      insert a new offence or remove an existing offence from columns 1 and 2 of the Schedule, and

 

(b)      vary the amount of a fixed penalty set out in columns 4 and 5 of the Schedule.

 

(3)       Any Ordinance, or subordinate legislation under this Law -

 

(a)       may be amended, repealed or revoked by a subsequent Ordinance, or subordinate legislation, as the case may be, hereunder,

 

(b)      may contain such consequential, incidental, supplementary, transitional and savings provisions as may appear to be necessary or expedient (including, without limitation, provision making consequential amendments to this Law and any other enactment)

 

(4)      Any power conferred by this Law to make any Ordinance, or subordinate legislation, may be exercised -

 

(a)      in relation to all cases to which the power extends, or in relation to all those cases subject to specified exceptions, or in relation to any specified cases or classes of cases, and

 

(b)      so as to make, as respects the cases in relation to which it is exercised -

 

(i)      the full provision to which the power extends, or any lesser provision (whether by way of exception or otherwise),

 

(ii)      the same provision for all cases, or different provision for different cases or classes of cases, or different provision for the same case or class of case for different purposes, and

 

(iii)      any such provision either unconditionally or subject to any prescribed conditions.

 

(5)      Any subordinate legislation made under this Law shall be laid before a meeting of the States as soon as may be after being made and if at that meeting or the next subsequent meeting the States resolve that the legislation be annulled, the legislation shall cease to have effect but without prejudice to anything done under that legislation or to the making of new subordinate legislation.

 

Interpretation.

8.      (1)      In this Law -

 

"band" has the meaning given in section 2(7)(c)(i),

 

"boat" includes every description of vessel used or intended to be used in navigation, by whatever means propelled,

 

"Chief Accountant" includes any person authorised by the Chief Accountant to carry out his functions under this Law,

 

"Chief Officer of Police" means the Chief Officer of the Island Police Force of Guernsey and includes anybody authorised by him for the purposes of this Law,

 

"Department" means the Home Department,

 

"enactment" means any Law, Ordinance or subordinate legislation,

 

"fixed penalty offence" has the meaning given in section 1,

 

"fixed penalty notice" has the meaning given in section 2,

 

"motor vehicle" means a mechanically propelled vehicle intended or adapted for use on the public highways,

 

"notice to owner" has the meaning given in section 3(1),

 

"owner" in relation to

 

(a)      a motor vehicle registered in Guernsey under the Ordinance entitled "Ordonnance supplémentaire à l'Ordonnance ayant rapport au Trafic Véhiculaire en cette Ile" and made permanent on 18th January 1932[b], means the person named as its owner in the registration book issued in respect of it under section 7(1) of that Ordinance, and

 

(b)       a boat registered in Guernsey under the Boats and Vessels (Registration, Speed Limits and Abatement of Noise) Ordinance, 1970[c], means the person named as its owner in the register of boats under section 3(1) of that Ordinance,

 

"person" includes any body or authority,

 

"police officer" means a member of the salaried police force of the Island of Guernsey and, within the limits of his jurisdiction, a member of the special constabulary of the Island of Guernsey,

 

"public highway" includes any road, street, lane or public place,

 

"States" means the States of Guernsey,

 

"subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any enactment and having legislative effect, and

 

"uniform scale" means the uniform scale of fines for the time being in force under the Uniform Scale of Fines (Bailiwick of Guernsey) Law, 1989[d].

 

(2)      Any reference in this Law to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.

 

Repeal.

9.      (1)      The following Ordinances are repealed -

 

(a)      the Traffic Offences (Fixed Penalties) Ordinance, 1989[e],

 

(b)      the Traffic Offences (Fixed Penalties) (Amendment) Ordinance, 1990[f],

 

(c)      the Traffic Offences (Fixed Penalties) (Amendment) Ordinance, 1999[g], and

 

(d)      the Traffic Offences (Fixed Penalties) (Amendment) Ordinance, 2007[h].

 

(2)      Notwithstanding subsection (1), the provisions repealed by that subsection shall continue to have effect in respect of any offence for which a fixed penalty notice under section 2 of the Traffic Offences (Fixed Penalties) Ordinance, 1989[i] has been issued before this Law comes into force.

 

Citation.

10.      This Law may be cited as the Offences (Fixed Penalties) (Guernsey) Law, 2009.

 

Commencement.

11.      This Law shall come into force on the day appointed by Ordinance of the States and such an Ordinance may appoint different dates for different provisions and for different purposes.
