The Social Insurance (Guernsey) (Amendment) Law, 2016

THE STATES, in pursuance of their Resolution of the 8th April, 2015[a] have approved the following provisions which, subject to the Sanction of Her Most Excellent Majesty in Council, shall have force of law in the Islands of Guernsey, Alderney, Herm and Jethou.

Amendment of the Social Insurance (Guernsey) Law, 1978.

1. (1) The Social Insurance (Guernsey) Law, 1978[b] ("the Law") is amended as follows.

(2) In the Sixth Schedule to the Law -

(a) for the meaning of "Pensionable age" in the second column substitute "The age specified in column 2 of the table at the end of this Schedule opposite the age category specified in column 1 of the table in which the person's date of birth falls.", and

(b) at the end insert the following table -

"Table for purposes of establishing pensionable age

Person born on or after 1st January, 1955 and before 1st November, 1955	65 years and 2 months
Person born on or after 1st November, 1955 and before 1st September, 1956	65 years and 4 months
Person born on or after 1st September, 1956 and before 1st July, 1957	65 years and 6 months
Person born on or after 1st July, 1957 and before 1st May, 1958	65 years and 8 months
Person born on or after 1st May, 1958 and before 1st March, 1959	65 years and 10 months
Person born on or after 1st March, 1959 and before 1st January, 1960	66 years
Person born on or after 1st January, 1960 and before 1st November, 1960	66 years and 2 months
Person born on or after 1st November, 1960 and before 1st September, 1961	66 years and 4 months
Person born on or after 1st September, 1961 and before 1st July, 1962	66 years and 6 months
Person born on or after 1st July, 1962 and before 1st May, 1963	66 years and 8 months
Person born on or after 1st May, 1963 and before 1st March, 1964	66 years and 10 months
Person born on or after 1st March, 1964 and before 1st January, 1965	67 years
Person born on or after 1st January, 1965 and before 1st November, 1965	67 years and 2 months
Person born on or after 1st November, 1965 and before 1st September, 1966	67 years and 4 months
Person born on or after 1st September, 1966 and before 1st July, 1967	67 years and 6 months
Person born on or after 1st July, 1967 and before 1st May, 1968	67 years and 8 months
Person born on or after 1st May, 1968 and before 1st March, 1969	67 years and 10 months
Person born on or after 1st March, 1969 and before 1st January, 1970	68 years
Person born on or after 1st January, 1970 and before 1st November, 1970	68 years and 2 months
Person born on or after 1st November, 1970 and before 1st September, 1971	68 years and 4 months
Person born on or after 1st September, 1971 and before 1st July, 1972	68 years and 6 months
Person born on or after 1st July, 1972 and before 1st May, 1973	68 years and 8 months
Person born on or after 1st May, 1973 and before 1st March, 1974	68 years and 10 months
Person born on or after 1st March, 1974 and before 1st January, 1975	69 years
Person born on or after 1st January 1975 and before 1st November 1975	69 years and 2 months
Person born on or after 1st November, 1975 and before 1st September, 1976	69 years and 4 months
Person born on or after 1st September, 1976 and before 1st July, 1977	69 years and 6 months
Person born on or after 1st July, 1977 and before 1st May, 1978	69 years and 8 months
Person born on or after 1st May, 1978 and before 1st March, 1979	69 years and 10 months
Person born on or after 1st March, 1979	70 years"

Amendment of Health Service (Benefit) Ordinance, 1990.

2. (1) The Health Service (Benefit) Ordinance, 1990[c] ("the Ordinance") is amended as follows.

(2) In section 3(2)(a) of the Ordinance, for "the age of 65 years" substitute "pensionable age".

(3) In section 9(1) of the Ordinance, immediately after the definition of "nurse prescriber" insert the following definition -

""pensionable age" has the meaning given by section 121(1) of the Social Insurance (Guernsey) Law, 1978,".

Interpretation.

3. (1) The Interpretation (Guernsey) Law, 1948[d] shall apply to the interpretation of this Ordinance throughout the Islands of Guernsey, Alderney, Herm and Jethou.

(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.

Citation.

4. This Law may be cited as the Social Insurance (Guernsey) (Amendment) Law, 2016.
