The King George The Fifth Memorial Playing Field Trust (Amendment) Law, 2024

THE STATES, in pursuance of their Resolution of the 20^th August 2020[a], have approved the following provisions which, subject to the Sanction of His Most Excellent Majesty in Council, shall have force of law in the Island of Guernsey.

Amendment of Law.

1. The King George The Fifth Memorial Playing Field Trust (Guernsey) Law, 1985[b] ("the Law") is amended as follows.

2. After section 1 of the Law, insert -

"Vesting of Friends of KGV Trust property in the King George the Fifth Trustees.

1A. On 1^st January, 2025, there shall vest in the King George The Fifth Trustees -

(a) all the real and personal property held by the Friends of KGV Trustees, free from any trusts to which that property may have been subject immediately before 1^st January, 2025, and

(b) all rights and liabilities acquired or incurred solely for the purposes of the Friends of KGV Trust to which the Friends of KGV Trustees were entitled or subject immediately before 1^st January, 2025.

Vesting of Friends of KGV Limited property in the King George The Fifth Trustees.

1B. On 1^st January, 2025 there shall vest in the King George The Fifth Trustees all the real property of the Friends of KGV Limited, a company registered in Guernsey with number 48691, and with regard to the land that shall vest in the King George The Fifth Trustees on that date, the Cadastre shall be amended accordingly.".

3. In section 2 of the Law, for "section 1", substitute "sections 1, 1A and 1B".

4. After section 2 of the Law, insert—

"Application of the Trusts (Guernsey) Law, 2007.

2A. Subject to the provisions of this Law, the Trusts (Guernsey) Law, 2007 applies to the Trust.".

5. In section 3(2)(b) of the Law, for "King George's Field", substitute "King George's Field, but, for the avoidance of doubt, the Trustees are empowered to alienate, charge or borrow on the security of the KGV Clubhouse".

6. For section 4 of the Law substitute -

"Appointment etc. of Trustees.

4. (1) The King George The Fifth Trustees shall be five persons as the Bailiff for the time being may from time to time appoint:

PROVIDED THAT until any other appointment is made under this section John Philip Greenfield, Stuart John Falla CBE, Shane Raymond Le Prevost, Janice Elizabeth Mancini and Andrew Douglas Laws shall be King George The Fifth Trustees as if they had been so appointed.

(2) Nothing in this section shall be construed as preventing -

(a) the resignation of a Trustee by notice in writing to the Bailiff for the time being, or

(b) the termination by the Bailiff for the time being of any appointment of a Trustee made under this section.".

7. In subsection 5(1) of the Law, after "purposes" insert, ", and in accordance with the Trusts (Guernsey) Law, 2007".

8. In section 7 of the Law -

(a) in the appropriate places insert -

""Friends of KGV Trust" means the Trust constituted by a Charitable Declaration of Trust on 18^th March 2013 by John Philip Greenfield, Mark Robert Thompson, Nigel Andrew Le Page, Stephen Robert Lloyd and Dominic Wheatley,",

""Friends of KGV Trustees" means the Trustee or Trustees of the Friends of KGV Trust,",

""KGV Clubhouse" means the building known as the KGV Clubhouse, as extended, together with parts of the adjoining car park and access road the curtilage of which is marked by a dotted line in the diagram attached in the Schedule,",

""the Trust" means the King George The Fifth Memorial Playing Field Trust,",

(b) for the definition of "King George's Field", substitute -

""King George’s Field" means the land conveyed by the 1937 Conveyance and the land vested in the King George The Fifth Trustees by section 1B, but does not include the KGV Clubhouse,",

(c) in the definition of "the Trust Property", for "section 1" substitute "sections 1, 1A or 1B".

9. At the end of the Law, insert as a schedule the Schedule contained in the Schedule to this Law.

Citation.

10. This Law may be cited as the King George The Fifth Memorial Playing Field Trust (Amendment) Law, 2024.

Commencement.

11. This Law shall come into force on 1^st January, 2025.
