The Reform (Sark) (Amendment) Law, 2022

THE CHIEF PLEAS OF SARK, in pursuance of their Resolution of the 6^th July, 2022, have approved the following provisions which, subject to the Sanction of Her Most Excellent Majesty in Council, shall have force of law in Sark.

Amendments to 2008 Law.

1. The Reform (Sark) Law, 2008[a] ("the 2008 Law"), is amended as follows.

2. In section 34(3) and (4) of the 2008 Law, after "Constable" in each case insert "present at the meeting".

3. In section 52 of the 2008 Law -

(a) for the heading substitute "Constables and Vingtenier.",

(b) in subsection (1), for "appoint a person, who is ordinarily resident" substitute "appoint one or more persons, who is or are ordinarily resident",

"(1A) Where, in pursuance of subsection (1), two or more persons ("the Constables") hold the office of Constable -

(a) any duties and powers assigned to the Constable by this Law or by any other enactment or rule of law may be performed or exercised by any one of the Constables, and

(b) where, in this Law or any other enactment or rule of law, a person holding the office of Constable is declared (for that reason) to be ineligible to hold any other specified office or appointment, each of the Constables shall be so ineligible,

and any reference to the Constable in this Law or any other enactment or rule of law shall be construed accordingly.".

4. For section 53(4), substitute -

"(4) It shall be the duty of the Constables, or in the absence or incapacity of the Constables, the Vingtenier, to ensure that the Assistant Constables carry out the respective duties of their office faithfully and well.".

5. (1) In sections 13(2), 50(2), 51(2), 53(2), 54(4) and 64(1) and (3) of the 2008 Law, for "the Constable", in each place where it occurs, substitute "a Constable".

(2) In section 54(1) of the 2008 Law, for "The Constable" substitute "A Constable".

6. In section 65(1), for "the Constable" substitute "Constable".

Interpretation.

7. In this Law, "the 2008 Law" means the Reform (Sark) Law, 2008.

Citation.

8. This Law may be cited as the Reform (Sark) (Amendment) Law, 2022.

Commencement.

9. This Law shall come into force on the date of its registration on the records of the Island of Sark.
