The Reform (Sark) Law, 2008
(Amendment) Ordinance, 2018
THE CHIEF PLEAS OF SARK, in pursuance of their Resolutions of the 17th January, 2018 and 4th July, 2018, and in exercise of the powers conferred on them by section 48 of the Reform (Sark) Law, 2008[a], hereby order:-
Amendments to 2008 Law.
1. The Reform (Sark) Law, 2008 is amended as follows.
2. In section 45 –
(a) in subsection (3), immediately after "the Treasurer," insert "the Sark Tax Assessor,", and
(b) immediately after subsection (3), insert the following additional subsections –
"(4) In subsection (3), "Sark Tax Assessor" means the holder of the office established by Schedule 2 of the Direct Taxes (Sark) Law, 2002.
(5) The Chief Pleas may from time to time by resolution prescribe rules of procedure applicable to Committees of the Chief Pleas, and rules made under this section may, in the like manner, be varied, revoked or suspended.".
3. In section 46, for subsections (1) and (2), substitute the following subsections –
"(1) The chairman of the Policy & Finance Committee shall be such person, being a Conseiller, who may from time to time be elected as such by the Chief Pleas; and the deputy chairman of that Committee shall be elected in like manner.
(2) Subject to subsection (1), the chairman and deputy chairman of a committee of the Chief Pleas shall be such members of that committee, being Conseillers, who are from time to time appointed as such chairman or deputy chairman, as the case may be, by the members of that committee.".
Interpretation.
4. (1) In this Ordinance -
"enactment" includes a Law, an Ordinance and any subordinate legislation and includes any provision or portion of a Law, an Ordinance or any subordinate legislation,
"subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any statutory, customary or inherent power and having legislative effect, but does not include an Ordinance.
(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.
(3) The Interpretation (Guernsey) Law, 1948[b] applies to the interpretation of this Ordinance.
Citation.
5. This Ordinance may be cited as the Reform (Sark) Law, 2008 (Amendment) Ordinance, 2018.
Commencement.
6. This Ordinance shall come into force on the 4th January, 2019.
