The Alderney (Application of Legislation) (Child Protection)

Ordinance, 2000

 

THE STATES, in pursuance of their Resolution of the 27th day of November, 1991[a], and in exercise of the powers conferred upon them by section 1 of the Alderney (Application of Legislation) Law, 1948[b], and of all other powers enabling them in that behalf, hereby order:-

 

Law of 1972 to have effect in Alderney.

1.      The Child Protection (Guernsey) Law, 1972[c] ("the 1972 Law") is, subject to the exceptions, adaptations and modifications specified in the Schedule, extended to the Island of Alderney.

 

Amendment to Ordinance of 1970.

2.      In the right hand column of the Schedule to the Alderney (Application of Legislation) (Education) Ordinance, 1970[d], delete the entries relating to sections 21 and 22 and insert the following entry in their place-

 

"In sections twenty-one and twenty-two, on each occasion where they occur, the words "the Magistrate's Court" are hereby deleted and the words "the Court of Alderney" are hereby substituted therefor."

 

Citation.

3.      This Ordinance may be cited as the Alderney (Application of Legislation) (Child Protection) Ordinance, 2000.

 

Commencement.

4.      This Ordinance shall come into force on the 1st April, 2000.

 

SCHEDULE

Section 1

 

EXCEPTIONS, ADAPTATIONS AND MODIFICATIONS SUBJECT TO

WHICH THE CHILD PROTECTION (GUERNSEY) LAW, 1972 IS

EXTENDED TO ALDERNEY

 

1.      Any reference in the 1972 Law to a Law or a provision of it is a reference to that Law or provision as it has effect in the Island of Alderney.

 

2.      On each occasion where they occur-

 

(a)      for the words "the Bailiff" substitute the words "the Chairman of the Court of Alderney"; and

 

(b)      for the words "the Royal Court" substitute the words "the Court of Alderney".

 

3.      In section 1(1)-

 

(a)      omit the definitions of "the Bailiff", "the Island of Guernsey", "probation order" and "the Royal Court"; and

 

(b)      in the definition of "officer of police", for "the special constabulary of the Island of Guernsey" substitute "the special constabulary of the Island of Alderney".

 

4.      Immediately after section 1(3) insert the following subsection-

 

"      (4)      The provisions of the Interpretation (Guernsey) Law, 1948[e] shall apply to the interpretation of this Law as they apply in Guernsey to the interpretation of an enactment."

 

5.      In section 5(5)(b), for "Guernsey" substitute "Alderney".

 

6.      Omit sections 7(1)(e) and 15(6)(c).

 

7.      In sections 16(8) and 18(1), for "the commencement of this Law" substitute "the day on which this Law comes into force in the Island of Alderney".

 

8.      Omit sections 25 to 29, 33 and 34(2) to (5) and the Schedule.
