The Building and Development Control (Alderney) (Amendment) Ordinance, 2023

THE STATES OF ALDERNEY, in pursuance of their Resolution of the 13^th September, 2023[a], and in exercise of the powers conferred on them by section 75 of the Building and Development Control (Alderney) Law, 2002[b], and all other powers enabling them in that behalf, hereby order:-

Amendment of the Law.

1. (1) Schedule 1 (descriptions of development or other work for which the Committee may grant permission in a designated area) to the Building and Development Control (Alderney) Law, 2002 is amended as follows.

(2) In paragraph 12 (other States development or other work) -

(a) in subparagraph (2) -

(i) in item (a), delete "or aircraft",

(ii) in item (b), for "port or airport" substitute "sea port",

(iii) in item (c), after "navigation lights" insert ", for the use of ships,",

(iv) delete the words "or an airport guidance station",

(b) after subparagraph (2), insert -

"(2A) Any development or other work to be carried out by or on behalf of the States or the States of Guernsey in any designated area which is necessary -

(a) for the safe navigation of aircraft,

(b) for the safe operation of an airport,

(c) to avoid the obstruction of navigation points or navigation lights, for the use of aircraft, by any tree or other vegetation, or

(d) for the construction, maintenance, alteration, replacement or extension of an airport.", and

"(9) In this paragraph "airport" includes, without limitation, an airport terminal building, an airport runway, an airport guidance station, an airport fire station and any other buildings, infrastructure or equipment, normally located at, or within the vicinity of, an airport, which are necessary or expedient for the operation of an airport.".

Citation.

2. This Ordinance may be cited as the Building and Development Control (Alderney) (Amendment) Ordinance, 2023.

Commencement.

3. This Ordinance shall come into force on 13^th September, 2023.
