The Misuse of Drugs (Bailiwick of Guernsey) Law, 1974 (Amendment) Ordinance, 2010
THE STATES, in pursuance of their Resolutions of the 31st May, 2007[a] and 27th October, 2010[b], and in exercise of the powers conferred on them by section 35 of the Misuse of Drugs (Bailiwick of Guernsey) Law, 1974[c], hereby order:-
Amendments to the 1974 Law.
1. The Misuse of Drugs (Bailiwick of Guernsey) Law, 1974 is amended as set out in the Schedule.
Interpretation.
2. (1) The Interpretation (Guernsey) Law, 1948[d] applies to the interpretation of this Ordinance throughout the Bailiwick of Guernsey.
(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.
Extent.
3. This Ordinance has effect throughout the Bailiwick of Guernsey.
Citation.
4. This Ordinance may be cited as the Misuse of Drugs (Bailiwick of Guernsey) Law, 1974 (Amendment) Ordinance, 2010.
Commencement.
5. This Ordinance comes into force on the 1st December, 2010.

AMENDMENTS TO MISUSE OF DRUGS (BAILIWICK OF GUERNSEY) LAW, 1974

Section 32(1) | Insert in the appropriate alphabetical order the following definitions -
" "customs officer" means an officer authorised under section 3 of the Customs and Excise (General Provisions) (Bailiwick of Guernsey) Law, 1972," and
" "this Law" includes any Ordinance or Order made under it,".
In the definition of "officer of police", substitute the first line with the following -
" "officer of police", subject to subsection (1A), means -".

New section 32(1A) | In section 32, immediately after subsection (1), insert the following subsection -
"(1A) A reference in this Law to an officer of police is deemed to include a reference to a customs officer.".

Third Schedule, the entries relating to section 17(1), (2) and (3) respectively | For the word "Order" in the second column, substitute in each instance the words "Ordinance or Order".
