The Insurance Managers and Insurance Intermediaries (Bailiwick of Guernsey) (Amendment) (No. 2) Ordinance, 2010

THE STATES, in pursuance of their Resolution of the 28^th July, 2010[a], and in exercise of the powers conferred on them by section 62 of the Insurance Managers and Insurance Intermediaries (Bailiwick of Guernsey) Law, 2002, as amended[b], and all other powers enabling them in that behalf, hereby order:-

Amendment of the Insurance Managers and Insurance Intermediaries Law.

1. The Insurance Managers and Insurance Intermediaries (Bailiwick of Guernsey) Law, 2002, as amended, is further amended as follows.

2. Section 44 is repealed.

3.. In section 50(1)(a), (2)(a) and (3)(a) the expression "44," is repealed.

4. In section 51 -

(a) paragraph (a) is repealed, and

(b) item (A) is repealed.

5. In section 57(k) for "44" substitute "45".

6. In section 65 for subsections (1) and (2) substitute -

"(1) A person guilty of an offence under section 5(5), 7(5), 11(5), 13(3), 16(6), 19(4), 20(3), 21(5), 21(6), 22(8), 25(3), 26(5), 28(2), 33(3), 35(3)(a), 38, 58(7), 61(8) or 64(2) is liable -

(a) on conviction on indictment, to a fine,

(b) on summary conviction, to a fine not exceeding level 5 on the uniform scale.

(2) A person guilty of an offence under any other provision of this Law is liable -

(a) on conviction on indictment, to imprisonment for a term not exceeding two years, or to a fine, or to both,

(b) on summary conviction, to imprisonment for a term not exceeding three months, or to a fine not exceeding level 5 on the uniform scale, or to both.".

Extent.

7. This Ordinance has effect throughout the Bailiwick.

Citation.

8. This Ordinance may be cited as the Insurance Managers and Insurance Intermediaries (Bailiwick of Guernsey) (Amendment) (No. 2) Ordinance, 2010.

Commencement.

9. This Ordinance shall come into force on the 28^th July, 2010.
