The Gambling (Betting and Crown and Anchor) (Amendment) Ordinance, 2016

THE STATES, in pursuance of their Resolutions of the 1^st November 2007[a] and 31^st July 2015[b], and in exercise of the powers conferred on them by sections 2 and 13(3) of the Gambling (Guernsey) Law, 1971[c], hereby order:-

Amendments to the 1973 Ordinance.

1. The Gambling (Betting) Ordinance, 1973[d] ("the 1973 Ordinance"), is further amended as follows.

2. In section 28(1) of the 1973 Ordinance –

(a) in paragraph (a), for "£800" substitute "£1,000",

(b) in paragraph (b), for "£1,600" substitute "£2,000", and

3. In paragraph 2 of the Second Schedule (Authorisation of Bookmaker's Agents) to the 1973 Ordinance, for "£40" substitute "£100".

4. In paragraph 2 of the Third Schedule (Bookmakers' Occasional Licences) to the 1973 Ordinance –

(a) in sub-paragraph (a) for "£40" substitute "£50", and

(b) in sub-paragraph (b) for "one hundred" substitute "three hundred".

Amendments to the 1983 Ordinance.

5. The Gambling (Crown and Anchor) (Guernsey) Ordinance, 1983[e] ("the 1983 Ordinance"), is further amended as follows.

6. In section 2(a)(iv) of the 1983 Ordinance, omit the words "principally out of doors".

7. In section 14(1) of the 1983 Ordinance, for "£50" substitute "£150".

8. In section 14(2) of the 1983 Ordinance, for "£50" substitute "£100".

Interpretation.

9. (1) In this Ordinance -

"enactment" includes a Law, an Ordinance and any subordinate legislation and includes any provision or portion of a Law, an Ordinance or any subordinate legislation,

"subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any statutory, customary or inherent power and having legislative effect, but does not include an Ordinance,

"the 1973 Ordinance" means the Gambling (Betting) Ordinance, 1973, and

"the 1983 Ordinance" means the Gambling (Crown and Anchor) (Guernsey) Ordinance, 1983.

(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.

Citation.

10. This Ordinance may be cited as the Gambling (Betting and Crown and Anchor) (Amendment) Ordinance, 2016.

Commencement.

11. This Ordinance shall come into force on the 1^st January, 2017.
