The Machinery of Government (Transfer of Functions) Ordinance, 2023
THE STATES, in pursuance of their Resolution of the 20th July, 2023[a], and in exercise of the powers conferred on them by sections 1 and 3 of the Public Functions (Transfer and Performance) (Bailiwick of Guernsey) Law, 1991[b], section 20 of the Interpretation and Standard Provisions (Bailiwick of Guernsey) Law, 2016[c],and all other powers enabling them in that behalf, hereby order:-
Transfer of Greffier's functions under the Limited Partnerships Law.
1. The functions, rights and liabilities of His Majesty's Greffier arising under the Limited Partnerships (Guernsey) Law, 1995[d] ("the Limited Partnerships Law") are transferred to and vested in the Registrar of Companies appointed under section 495 of the Companies (Guernsey) Law, 2008[e].
Amendment of statutory references.
2. (1) In section 35 of the Limited Partnerships Law, for "any other officer" substitute "any officer", and in section 41(1) of the Limited Partnerships Law, delete the definition of "the Greffier".
(2) For any reference in the Limited Partnerships Law and any Ordinance and subordinate legislation made under it, to His Majesty's Greffier, however expressed, there is substituted a reference to the Registrar of Companies.
(3) For any reference in any other enactment to His Majesty's Greffier undertaking functions under the Limited Partnerships Law, howsoever expressed, there is substituted a reference to the Registrar of Companies acting in his or her capacity under the Limited Partnerships Law.
Savings and transitional provisions.
3. Anything done before the date of commencement of this Ordinance, or in the process of being done on that date, by or in relation to His Majesty's Greffier under the Limited Partnerships Law shall have effect as if done, or (as the case may be) may be continued, by or in relation to the Registrar of Companies (acting in his or her capacity under the Limited Partnerships Law).
Citation.
4. This Ordinance may be cited as the Machinery of Government (Transfer of Functions) Ordinance, 2023.
Commencement.
5. This Ordinance shall come into force on the 27th day of July, 2023.
