The Liquor Licensing (Renewal Date and Fees) Ordinance, 2020
THE STATES POLICY & RESOURCES COMMITTEE, in exercise of the powers conferred on the States by sections 1 and 3 of the Control of Intoxicating Liquor (Enabling Provisions) (Guernsey) Law, 2006[a] as read with section 99 of the Liquor Licensing Ordinance, 2006[b], and all other powers enabling them in that behalf, and in exercise of the powers conferred on the Committee by Article 66A(1) of the Reform (Guernsey) Law, 1948[c], hereby order:-
Temporary modification of effect of the Liquor Licensing Ordinance, 2006.
(1) Subject to section 4, the Liquor Licensing Ordinance, 2006 ("the 2006 Ordinance") has effect as if it were subject to the following modifications.
(2) For subsections (1) and (2) of section 11, substitute –
"(1) Unless suspended or forfeited under this Ordinance, a liquor licence granted under section 9 shall be valid from such day as the Royal Court directs until 30th November 2020 and thereafter, if renewed, shall be valid until 31st May 2021; provided that where the licensee is already the holder of one or more liquor licences, any licence granted under section 9 shall be valid during such period, not exceeding 28 days, as the Royal Court may direct.
(2) A liquor licence granted under this Part shall, subject to the provisions of subsections (3) to (6) and section 13, be renewed upon the payment to the Committee, on or before 30th November 2020, of the relevant fee in one payment, and, in default of payment, shall cease to be valid on the 1st December 2020.
(2A) The Committee may, on application being made to it, direct that a reduced renewal fee (including a nil fee) is payable in respect of any licensed premises –
(a) the operation of which has been affected by provision in emergency regulations made under the Civil Contingencies (Bailiwick of Guernsey) Law, 2012, or in a direction made thereunder, or
(b) in circumstances where the liquor licence in respect of those premises was granted under section 9 after 1st June, 2020.".
Amendment of regulation 4 of the Liquor Licensing (Fees) Regulations, 2020.
(1) The Liquor Licensing (Fees) Regulations, 2020[d] are amended as follows.
(3) In regulation 4, for "1st June, 2020" substitute "1st December, 2020".
Citation.
3. This Ordinance may be cited as the Liquor Licensing (Renewal Date and Fees) Ordinance, 2020.
Commencement, duration and saving.
4. (1) This Ordinance shall come into force on 27th May, 2020.
(2) Subject to subsection (3), section 1 shall cease to have effect on the 2nd December, 2020.
(3) For the avoidance of doubt, the ceasing of the effect on 2nd December, 2020 of the modifications of the 2006 Ordinance made by section 1, pursuant to subsection (2), shall not affect anything done under, for the purposes of, in reliance on or otherwise having effect pursuant to, the provisions of the 2006 Ordinance as so modified, including, but not limited to, the renewal of any liquor licence, and the ceasing of the validity of any liquor licence.
