The Island Development (Sheltered Housing Use Class) Ordinance, 2000

THE STATES, in pursuance of their Resolution of 28th June 2000[a], and in exercise of the powers conferred on them by section 1 of the Island Development (Amendment) (Guernsey) Law, 1988[b], hereby order:-

Sheltered Housing Use Class.

1.      In the Island Development (Use Classes ) Ordinance, 1991[c]

(a)      immediately after Residential use Class 4 in Schedule 1 there is inserted:

"Residential use Class 4A:      Use of one of a group of dwellings for the time being recognised by the Island Development Committee as affording facilities specially suited to the needs of older or disabled people, including the on-call assistance of a resident or nearby warden -

(i) as a permanent residence for a person living alone who, or

(ii) as a permanent residence for two persons living together of whom at least one,

either has attained an age of 55 years, or requires access to those facilities because of his or her disability.";

(b)      in each of Use classes 1, 2, 3 and 4 in Schedule 1, immediately after "Use" there is inserted ", not falling within Use Class 4A,".

Citation and Collective Title.

2.      (1)      This Ordinance may be cited as the Island Development (Sheltered Housing Use Class) Ordinance, 2000.

(2)      This Ordinance and the Island Development (Use Classes) Ordinance, 1991 may be cited as the Island Development (Use Classes) Ordinances, 1991 and 2000.
