The Driving Licences (Guernsey) (Amendment) Ordinance, 2002
THE STATES, in pursuance of their Resolution of the 30th day of June, 1999[a] and in exercise of the powers conferred upon them by sections 2 and 28 of the Motor Taxation and Licensing (Guernsey) Law, 1987[b], as amended, hereby order:-
Amendments to the Ordinance of 1995.
1. In the Driving Licences (Guernsey) Ordinance, 1995[c], as amended:
(a) in the ARRANGEMENT OF SECTIONS after the entry relating to section 4 insert:
"4A. Theory Tests.";
(b) immediately after section 4 insert the following section:
"Theory tests.
4A. (1) A person shall not submit himself for a test of competence under section 4 unless he satisfies the Committee that he has, at some time during the period of two years ending on the date of the test, passed a theory test prescribed by virtue of this section.
(2) The Committee may by regulation make such provision as they consider necessary or expedient in respect of the nature, subject matter and conduct of the theory test, evidence of the results thereof, and generally with respect to such tests.
(3) For the purposes of this Ordinance a 'theory test' means a test carried out for the purpose of establishing whether or not a person has sufficient theoretical knowledge and understanding of such matters relevant to the safe, competent and careful driving of motor vehicles as may be prescribed.
(4) Without prejudice to the generality of subsection (2), the Committee may by regulation provide for:
(a) the fees chargeable in respect of a person applying for a theory test or in respect of certificates evidencing the result;
(b) circumstances in which persons are exempt from the requirement imposed by subsection (1);
(c) conditions and requirements in respect of theory tests for different categories of licence;
and different regulations may be made with respect to theory tests to drive different classes of vehicle.
(5) The Committee may in its discretion permit an application for a test of competence under section 4 notwithstanding that the period which has elapsed since the theory test was passed exceeds two years.
(6) Regulations under this section -
(a) may be amended or repealed by subsequent regulations hereunder;
(b) may contain such consequential, incidental, supplemental and transitional provision as may appear to the Committee to be necessary or expedient;
(c) shall be laid before a meeting of the States as soon as possible and shall, if at that or at the next meeting the States resolve to annul them, cease to have effect, but without prejudice to anything done under them or to the making of new regulations.".
Citation & commencement.
2. (1) This Ordinance may be cited as the Driving Licences (Guernsey) (Amendment) Ordinance, 2002.
(2) This Ordinance shall come into force on such date as the States Traffic Committee may by regulation appoint.
