The Road Traffic (Restriction on Use of Mobile Telephones) (Guernsey) Ordinance, 2003

 

THE STATES, in pursuance of their Resolution of the 25th day of September, 2003[a] hereby order:-

 

Restriction on use of telephones.

1.      (1)      If any person who is driving a motor vehicle on a road holds a telephone in any way while the vehicle is in motion, he shall be guilty of an offence.

 

(2)      A person guilty of an offence under subsection (1) shall be liable to a fine not exceeding level 2 of the uniform scale of fines designated by the Uniform Scale of Fines (Bailiwick of Guernsey) Law, 1989[b].

 

Interpretation.

2.      In this Ordinance -

 

"motor vehicle" means a mechanically propelled vehicle intended or adapted for use on a road; and

 

"road" means any road, street, lane, way or place which is a public highway or to which the public have access, and includes any road owned by the States which is not a public highway.

 

Citation.

3.      This Ordinance may be cited as the Road Traffic (Restriction on Use of Mobile Telephones) (Guernsey) Ordinance, 2003.
