The Boats and Vessels (Registration, Speed Limits and Abatement of Noise) (Amendment) Ordinance, 2008

 

THE STATES, in pursuance of their Resolution of the 10th March 2004a[a], and in exercise of all other powers enabling them in that behalf, hereby order:-

 

Amendment of the 1970 Ordinance.

1.      In Part I of the Boats and Vessels (Registration, Speed Limits and Abatement of Noise) Ordinance, 1970, as amended[b] ("the 1970 Ordinance"), at the end of section 3(3)(e), for "." substitute ";", and after insert -

 

"(f)      the owner or the designated owner thereof is no longer ordinarily resident in the islands of Guernsey, Herm or Jethou, he shall, as soon as practicable, inform the Board in writing of the fact and return the certificate of registration relating to the boat to the Board, and the Board shall delete the entry relating to the boat from the register of boats and cancel the said certificate.".

 

2.      In Part I of the 1970 Ordinance, after section 4(2) insert -

 

"Board may require confirmation and evidence of residence.

4A.      (1)      The Board may at any time by notice in writing served on the owner or the designated owner, as the case may be, of a boat registered in pursuance of the provisions of this Part of the Ordinance, require the said owner or designated owner to confirm to the Board, within such period as may be specified in the notice, that he remains ordinarily resident in the islands of Guernsey, Herm or Jethou; and the Board may require him, in the notice or otherwise, to provide evidence in support of such a confirmation.

 

(2)      If an owner or the designated owner, as the case be, of a boat registered in pursuance of the provisions of this Part of the Ordinance, on whom a notice has been served under subsection (1) above, refuses or fails to comply with the requirements of that notice or to provide evidence required by the Board under that subsection, or if the Board is otherwise satisfied that he is no longer ordinarily resident in the islands of Guernsey, Herm or Jethou, the Board shall delete the entry relating to the boat from the register of boats; and thereupon the certificate of registration relating to the boat shall cease to be valid.".

 

Citation.

3.      This Ordinance may be cited as the Boats and Vessels (Registration, Speed Limits and Abatement of Noise) (Amendment) Ordinance, 2008.

 

Commencement.

4.      This Ordinance shall come into force on the 27th February, 2008.
