The Income Support (Implementation) (Amendment) Ordinance, 2025
THE STATES, in pursuance of their Resolution of the 20th November, 2024[a], and in exercise of the powers conferred upon them by sections 3(2) and (4), 15 and 15B of the Income Support (Guernsey) Law, 1971[b], and all other powers enabling them in that behalf, hereby order:-
Amendment of Ordinance.
1. (1) The Income Support (Implementation) Ordinance, 1971[c] ("the principal Ordinance") is amended as follows.
(2) In section 26(1) (interpretation) of the principal Ordinance, insert the following definitions in the appropriate places –
""approved blood scheme" means a scheme established or approved by the Secretary of State, or trust established with funds provided by the Secretary of State, for the purpose of providing compensation in respect of a person having been infected from contaminated blood products,",
""Scottish Infected Blood Support Scheme" means the scheme of that name administered by the Common Services Agency (constituted by section 10 of the National Health Service (Scotland) Act 1978),", and
""the Secretary of State" means the Secretary of State of His Majesty's Government for the purposes of any of the following:
(a) the Income Support (General) Regulations 1987,
(b) the Jobseeker's Allowance Regulations, 1996,
(c) the Housing Benefit Regulations 2006,".
(3) After subparagraph (l) of paragraph 11 of the First Schedule to the principal Ordinance, insert the following subparagraphs –
"(m) any payment made under or by an approved blood scheme or the Scottish Infected Blood Support Scheme,
(n) any payment out of the estate of a person, which derives from a payment made under or by an approved blood scheme or the Scottish Infected Blood Support Scheme to the estate of the person as a result of that person having been infected from contaminated blood products.".
Extent.
2. This Ordinance has effect in the Islands of Guernsey, Alderney, Herm and Jethou.
Citation.
3. This Ordinance may be cited as the Income Support (Implementation) (Amendment) Ordinance, 2025.
