The Post Office (Bailiwick of Guernsey) (Amendment) Ordinance, 2010

THE STATES, in pursuance of their Resolution of the 28^th July, 2010[a], and in exercise of the powers conferred on them by section 48(1) of the Post Office (Bailiwick of Guernsey) Law, 2001, as amended[b] and all other powers enabling them in that behalf, hereby order:-

Amendment of Law.

1. The Post Office (Bailiwick of Guernsey) Law, 2001, as amended, is further amended as follows.

2. After section 37(2)(a) insert the following paragraph -

"(aa) specifying the meaning of the expression "goods" for the purposes of this section and section 38, and for the avoidance of doubt the definition may include anything contained in a postal packet, including (without limitation) cash within the meaning for the time being given by the Cash Controls (Bailiwick of Guernsey) Law, 2007,".

3. In section 37(2)(b) after "such packets" insert "and such goods".

4. In section 37(2)(e) after "observance" insert ", implementation, administration and enforcement".

5. In section 37(2)(f) for "punishing any contravention of the regulations" substitute "the creation, trial (summarily or on indictment) and punishment of offences".

6. In section 45(1) -

(a) after the definition of "Court" insert the following definition -

""customs and excise Laws" means those provisions of the Customs and Excise (General Provisions) (Bailiwick of Guernsey) Law, 1972 and any other enactment for the time being in force relating to customs or, as the case may be, excise,",

(b) after the definition of "dominant position" insert the following definition -

""enactments in relation to taxes, duties and impôts" includes, for the avoidance of doubt, the customs and excise Laws, and related expressions shall be construed accordingly,".

Citation.

7. This Ordinance may be cited as the Post Office (Bailiwick of Guernsey) (Amendment) Ordinance, 2010.

Commencement.

8. This Ordinance shall come into force on the 28^th July, 2010.
