Law, 2001 (Amendment) Ordinance, 2025

the Policy & Resources Committee, in exercise of the powers conferred on them by article 66A of the Reform (Guernsey) Law, 1948[a], section 34 of the Telecommunications (Bailiwick of Guernsey) Law, 2001[b], and all other powers enabling them in that behalf, hereby order:-

Amendment to the Telecommunications Law.

1. (1) The Telecommunications (Bailiwick of Guernsey) Law, 2001 is amended as follows.

(2) In section 1(5), for "the Telecommunications Act" substitute "the Communications Act 2003".

(3) In subsection (1) of section 11 (numbering), for "the Director General of Telecommunications appointed under the Telecommunications Act" substitute "OFCOM", and after subsection (1) insert -

"(1A) For the avoidance of doubt, and in accordance with section 1(2) of the Communications Act 2003 as extended to the Bailiwick, under subsection (1) the Authority may enter into an arrangement with OFCOM under which OFCOM shall have the function of establishing a numbering scheme in the Bailiwick, including (for the avoidance of doubt) the power to do anything incidental or conducive to the carrying out of that function, and such a scheme shall be susceptible to modification by OFCOM after consultation with the Authority; and subsection (1) shall be construed accordingly.".

(4) In subsection (1) of section 31 (interpretation) –

(a) in the definition of "numbers", for "the Director General of Telecommunications appointed under the Telecommunications Act" substitute "OFCOM",

(b) in the appropriate alphabetical order insert –

""OFCOM" means the Office of Communications established under section 1 of the Office of Communications Act 2002,",

(c) the definition of "Telecommunications Act" is deleted, and

(d) in the definition of "Wireless Telegraphy Act", for "1949" substitute "2006".

Citation.

2. This Ordinance may be cited as the Telecommunications (Bailiwick of Guernsey) Law, 2001 (Amendment) Ordinance, 2025.

Commencement.

3. This Ordinance shall come into force on the day it is made.
