The Transfer of Funds (Sark) (Amendment) Ordinance, 2010

THE CHIEF PLEAS OF SARK, in pursuance of their Resolution of the 14th April, 2010, and in exercise of the powers conferred on them by sections 1 and 4 of the European Communities (Implementation) (Bailiwick of Guernsey) Law, 1994[a] and of all other powers enabling them in that behalf, hereby order:

Amendment of the 2007 Ordinance.

1. (1) The Transfer of Funds (Sark) Ordinance, 2007[b] is amended as follows.

(2) In section 10(1)(a) (cooperation obligations), for "section 25, 26," substitute "section 25, 26(1), 26A,".

(3) In section 11 (monitoring and enforcement-information seeking powers) -

(a) in subsection (1), for " and 26 (right of entry to obtain information and documents)" substitute ", 26(1) (power of Bailiff to grant warrant) and 26A (powers conferred by Bailiff's warrant granted under section 26)", and

(b) in subsection (4), for "section 25, 26, 28 or 29" substitute "section 25, 26(1), 26A, 28, 29 or 44".

Interpretation.

2. (1) The Interpretation (Guernsey) Law, 1948[c] applies to the interpretation of this Ordinance.

(2) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.

Citation and commencement.

3. This Ordinance may be cited as the Transfer of Funds (Sark) (Amendment) Ordinance, 2010 and shall come into force on the date it is approved by the Chief Pleas.
