The Reform (Elections of Conseillers) (General Provisions) (Sark) (Amendment) Ordinance, 2016
THE CHIEF PLEAS OF SARK, in pursuance of their Resolution of the 10th November, 2016, and in exercise of the powers conferred on them by section 26 of the Reform (Sark) Law, 2008[a], hereby order:-
Amendments to 2008 Ordinance.
1. The Reform (Elections of Conseillers) (General Provisions) (Sark) Ordinance, 2008[b] ("the 2008 Ordinance") is amended as follows.
2. In sections 5(1) and (6), 6(2), 12, and 13(3), for "La Gazette Officielle" substitute "the Sark Gazette".
3. In section 18(1), the definition of "La Gazette Officielle" is repealed and the following definition is inserted immediately after the definition of "returning officer" -
""the Sark Gazette" means the Sark Gazette Officielle published on the website of the Sark Gazette Officielle,".
Savings provision.
4. Any notice given, in accordance with the provisions of the 2008 Ordinance, in La Gazette Officielle prior to the commencement of this Ordinance shall, after such commencement, be deemed for the purposes of that Ordinance to have been given in the Sark Gazette.
Interpretation.
5. (1) In this Ordinance -
"enactment" includes a Law, an Ordinance and any subordinate legislation and includes any provision or portion of a Law, an Ordinance or any subordinate legislation,
"La Gazette Officielle" means La Gazette Officielle published in Guernsey,
"the Sark Gazette" means the Sark Gazette Officielle published on the website of the Sark Gazette Officielle,
"subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made under any statutory, customary or inherent power and having legislative effect, but does not include an Ordinance.
(2) The Interpretation (Guernsey) Law, 1948[c] applies to the interpretation of this Ordinance as that Law applies to the interpretation of a Guernsey enactment.
(3) Any reference in this Ordinance to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied.
Citation.
6. This Ordinance may be cited as the Reform (Elections of Conseillers) (General Provisions) (Sark) (Amendment) Ordinance, 2016.
Commencement.
7. This Ordinance shall commence on the 10th November 2016.
