This is the Plaintiff’s application for summary judgment on its claim against the Defendant and reverse summary judgment in relation to the Defendant’s counterclaim under Rule 19 of the Royal Court Civil Rules 2007 (the “RCCR”) or in the alternative that the defences and/or counterclaim of the Defendant be struck out under Rule 52 of the RCCR (the “Applications”).
