Failing to discharge its duties as an employer under Section 2(1) of the Health and Safety at
Work (General) (Guernsey) Ordinance 1987, as amended, in that it failed to conduct its
undertaking, namely the installation of heavy refrigeration units, in such a way as to ensure,
as far as was reasonably practicable, that persons not in its employment who may be affected
were not thereby exposed to risk to their health and safety.
